Off sick? What changed in 2026

Fewer days without a sick note, faster end of contract after long illness and new contact rules with your employer.

Since 1 January 2026 new rules apply to employees who are ill. The goal: a faster and better return to work. Here is what it means for you.

What is changing?

Fewer days without a sick note: only 2 times a year a sick day without a doctor’s certificate (was 3). Small employers can be stricter through your contract.
Your employer stays in touch: the work rules say who contacts you during your illness and how often.
Contract can end sooner: after 6 months of continuous illness your employer can already start a “medical force majeure” procedure (was 9 months).
Ill again after returning? You now need to have worked 8 weeks again before you are once more entitled to guaranteed pay from your employer (was 14 days).
Cooperation remains mandatory: if you do not attend the health insurance fund’s medical adviser or the return-to-work coordinator without a valid reason, your benefit can be reduced.
